Motion to Quash

When you are served with a subpoena, one thing you might need to do is to file a motion to quash.  This is a motion you file with the relevant court to demand that you do not have to follow the subpoena or respond to it.  You might also need to file a motion for a protective order (to limit the production or use of documents requested in the subpoena).  Our arbitration and litigation law firm can help you file or respond to these types of motions.

Confidentiality Agreements

Another possiblity when responding to a subpoena is to seek a confidentiality agreement with the party that served the subpoena.  in other words, reach a written agreement to limit how the produced documents are used in the litigation, and for example, to make sure the documents are shredded at the end.

Request for Production of Documents

Where you have two parties litigating against each other in a case (ex. a Plaintiff vs. Defendant or Complainant vs. Respondent), you may be able to send the other party "request for production / inspection of documents.  This is basically the same thing as serving a subpoena.  As party to a case, they will usually be required to answer.
